Thank you for using myfreefoam! These terms of service (the “Terms”) govern your access to and use of myfreefoam (“we” or “our”) websites and services (the “Services”), so please carefully read them before using the Services.

By using the Services you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. In that case, “you” and “your” will refer to that organization.

You may use the Services only in compliance with these Terms. You may use the Services only if you have the power to form a contract with myfreefoam and are not barred under any applicable laws from doing so. The Services may continue to change over time as we refine and add more features. We may stop, suspend, or modify the Services at any time without prior notice to you. We may also remove any content from our Services at our discretion.

By using our Services you provide us with information about yourself and your company that you submit to myfreefoam. You retain full ownership of this information and we do not claim any ownership to any of it. These Terms do not grant us any rights to your stuff or intellectual property except for the limited rights that are needed to run the Services, as explained below.

We may need your permission to do things you ask us to do with your information, for example, hosting files or images belonging to you, or sharing them at your direction. It also includes design choices we make to technically administer our Services, for example, how we redundantly backup data to keep it safe. You give us the permissions we need to do those things solely to provide the Services. This permission also extends to trusted third parties we work with to provide the Services, for example Heroku, which hosts this website and Amazon, which provides our storage space (again, only to provide the Services).

To be clear, aside from the rare exceptions we identify in our Privacy Policy, no matter how the Services change, we won’t share your content with others, including law enforcement, for any purpose unless you direct us to. How we collect and use your information generally is also explained in our Privacy Policy

You are solely responsible for your conduct and your communications with others while using the Services. For example, it’s your responsibility to ensure that you have the rights or permission needed to comply with these Terms. It is also your responsibility to ensure that you do not share your access to this service with other non-trusted third parties.

We may choose to review public content for compliance with our community guidelines, but you acknowledge that myfreefoam has no obligation to monitor any information on the Services. We are not responsible for the accuracy, completeness, appropriateness, or legality of files, user posts, or any other information you may be able to access using the Services.

You are responsible for safeguarding the password that you use to access the Services and you agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized that activity. You should immediately notify myfreefoam of any unauthorized use of your account. You acknowledge that if you wish to protect your transmission of data or files to myfreefoam, it is your responsibility to use a secure encrypted connection to communicate with the Services.

myfreefoam provides a service that allows the registered user to order quantities of marketing materials such a brochures, swatches and guides. Provision of this service is subject to fair-use limits as follows:

The user cannot order more than the maximum order quantity per item per calendar month. Subsequent orders for items already ordered up to the maximum limit within this time period will be cancelled and not processed by myfreefoam.

If you require quantities of items greater than that allowed by the ordering system, then please contact customer support.

myfreefoam provides a service that allows a registered installer to register products they have installed for an extended guarantee. The registered installer must indicate in their preferences if they wish Freefoam to send the guarantee certificate to the owner of the property where the installation took place.

If the registered installer changes their preferences at any time, Freefoam will apply these preferences from that point forward. Freefoam will not retrospectively process any certificates registered prior to this change.

Though we want to provide a great service, there are certain things about the service we can’t promise. For example, THE SERVICES AND SOFTWARE ARE PROVIDED “AS IS”, AT YOUR OWN RISK, WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. myfreefoam will have no responsibility for any harm to your computer system, loss or corruption of data, or other harm that results from your access to or use of the Services or Software. Some countries do not allow the types of disclaimers in this paragraph, so they may not apply to you.

We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you (for example via email to the email address associated with your account). Other changes may be posted to our blog or terms page, so please check those pages regularly. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Services.

Freefoam manufactured white PVC-UE roofline and PVC-U rainwater products ("Freefoam Products") are guaranteed upon and subject to the following terms and conditions:

1. The period of the guarantee ("the Guarantee period") is 20 years from the date of installation of the Freefoam products and is extended to a Lifetime Guarantee of 50 years from that date if (but only if) no other brand is used in any of the following installations: 1. fascia + rainwater; 2. soffit; 3. rainwater; 4. cladding (excluding Fortex embossed products), and the installation duly registered with Freefoam Plastics through their website www.myfreefoam.com within one month of its completion. Fortex white cladding products are covered by the standard 20 year guarantee.
2. The guarantee applies to defects in Freefoam Products appearing within the guarantee period which consist of warping splitting or cracking or of discolouration which in the case of roofline profiles and mouldings is not in conformity with the colourfastness and weathering criteria defined in BS EN 13245-3:2010, BS EN 13245-2:2008, BS7619:2010 and in the case of rainwater profiles and mouldings is not in conformity with the colourfastness and weathering criteria defined in BS EN 607:1995 section 10.
3. The guarantee will only apply:
   • if the defects are notified to Freefoam Plastics in writing within 3 months of their appearance together with proof of purchase.
   • if the Freefoam Products in question were installed and have been used and maintained in accordance with the instructions contained in Freefoam's Freeflow Installation Guide (for rainwater profiles and mouldings), and Technical & Product Notes and Freefoam's Roofline Technical Manual (for roofline profiles and mouldings) all of which are available for download from Freefoam Plastics website www.freefoam.com.
   • to Freefoam Products installed in Ireland or the United Kingdom. N.B. A separate guarantee applies elsewhere.
   • following inspection of the defects and approval by Freefoam Plastics.
4. Exclusions:

   The guarantee does not apply to any of the following:

   • Fair wear and tear, normal aging and damage caused by external physical agents, storms, exceptional weather, accidental damage or other Force Majeure.
   • Fair wear and tear above includes wear to seals in rainwater accessories which may require replacement during the term of the guarantee.
   • Performance outside scope of BS7619 1993
   • any aspect of the installation of Freefoam Products

   The application of any coating, paint or other surface treatment will void the guarantee.

5. Freefoam Plastics liability under the guarantee is limited (at their absolute discretion) to the repair or replacement of defective materials or to the payment in cash of the original cost of the Freefoam Products in question. Freefoam Plastics will not be responsible for consequential loss of any kind. Having regard to the number of years of satisfactory use Freefoam will contribute to the cost in the proportion that the unexpired years of the Guarantee bear to the original Guarantee term, as outlined in the schedule below, subject to Freefoam’s written agreement. Freefoam will not be liable to contribute to the cost where work is carried out prior to such agreement.
   Pro-rated Schedule:

6. The guarantee may be transferred to second or subsequent owners during the first 10 years from the date of installation only. Every change of ownership within that must be registered with Freefoam Plastics through their website www.freefoam.com within one month of the change for the guarantee to remain in effect.
7. This guarantee does not affect the statutory rights of consumers.
8. The guarantee shall be interpreted only in accordance with English Law and be subject to the jurisdiction of the English courts in respect of installations in the United Kingdom, and in accordance with Irish Law and be subject to the jurisdiction of the Irish courts in respect of installations in the Irish Republic and elsewhere.
9. These terms and conditions will apply in respect of products fitted on or after the date noted here.

Freefoam manufactured coloured PVC-UE roofline and PVC-U rainwater products ("Freefoam Products") are guaranteed upon and subject to the following terms and conditions:

1. The period of the guarantee ("the Guarantee period") is 10 years from the date of installation of the Freefoam products. A guarantee certificate may be obtained if the installation is duly registered with Freefoam Plastics through their website www.myfreefoam.com within one month of its completion.
2. The guarantee applies to defects in Freefoam Products appearing within the guarantee period which consist of warping splitting or cracking or of discolouration which in the case of roofline profiles and mouldings is not in conformity with the colourfastness and weathering criteria defined in BS EN 13245-3:2010, BS EN 13245-2:2008, BS7619: 2010 and in the case of rainwater profiles and mouldings is not in conformity with the colourfastness and weathering criteria defined in BS EN 607:1995 section 10.
3. The guarantee will only apply:
   • If the defects are notified to Freefoam Plastics in writing within 3 months of their appearance together with proof of purchase.

   • Following inspection of the defects and approval by Freefoam Plastics.

   • Fair wear and tear, normal aging and damage caused by external physical agents, storms, exceptional weather, accidental damage or other Force Majeure.
   • Fair wear and tear above includes wear to seals in rainwater accessories which may require replacement during the term of the guarantee.
   • Performance outside scope of BS EN 13245-3:2010, BS EN 13245-2:2008, BS7619:2010
   • any aspect of the installation of Freefoam Products

   The application of any coating, paint or other surface treatment will void the guarantee.

6. The guarantee will apply in the same terms to second or subsequent owners provided every change of ownership is duly registered with Freefoam Plastics through their website www.myfreefoam.com within one month of the change.
7. This guarantee does not affect the statutory rights of consumers.
8. The guarantee shall be interpreted only in accordance with English Law and be subject to the jurisdiction of the English courts in respect of installations in the United Kingdom, and in accordance with Irish Law and be subject to the jurisdiction of the Irish courts in respect of installations in the Irish Republic and elsewhere.
9. These terms and conditions will apply in respect of products fitted on or after the date noted here.

Freefoam foiled woodgrain PVC-UE roofline products ("Freefoam Products") are guaranteed upon and subject to the following terms and conditions:

1. The period of the guarantee ("the Guarantee period") is 10 years from the date of installation of the Freefoam products. A guarantee certificate may be obtained if the installation is duly registered with Freefoam Plastics through their website www.myfreefoam.com within one month of its completion.
2. The guarantee applies to defects in Freefoam Products appearing within the guarantee period which consist of warping splitting or cracking or of discolouration which in the case of roofline profiles and mouldings is not in conformity with the colourfastness and weathering criteria defined in BS EN 13245-3:2010, BS EN 13245-2:2008, BS7619:2010.
3. The guarantee will only apply:
   • if the defects are notified to Freefoam Plastics in writing within 3 months of their appearance together with proof of purchase.
   • if the Freefoam Products in question were installed and have been used and maintained in accordance with the instructions contained in Freefoam's Technical & Product Notes and Freefoam's Roofline Technical Manual (for roofline profiles and mouldings) all of which are available for download from Freefoam Plastics website www.freefoam.com.
   • when fitted in a Northern European climate i.e. < 100 KLY
   • following inspection of the defects and approval by Freefoam Plastics.
4. Exclusions:

   The guarantee does not apply to any of the following:

   • Performance outside scope of BS EN 13245-3:2010, BS EN 13245-2:2008, BS7619:2010
   • any aspect of the installation of Freefoam Products

7. This guarantee does not affect the statutory rights of consumers.

The guarantee shall be interpreted only in accordance with English Law and be subject to the jurisdiction of the English courts in respect of installations in the United Kingdom, and in accordance with Irish Law and be subject to the jurisdiction of the Irish courts in respect of installations in the Irish Republic and elsewhere.
9. The guarantee is limited to end use of the products at elevations below 1800 metres above sea-level.
10. The Freefoam products are also guaranteed to perform in accordance to BS2782 and DIN 53455.
11. These terms and conditions will apply in respect of products fitted on or after the date noted here.
